Who is a Resident under the Assisted Living Statute?

Under assisted living licensure, everyone who resides in the licensed assisted living setting is a resident by definition. We continue to work through the implications of the definition of your requirements as an assisted living provider, but several components are known.
Like under the Housing with Services requirements, every resident must have a contract in compliance with the new license, receive the Uniform Disclosure of Assisted Living Services Agreement (UDALSA), and receive other required disclosures. In addition, a change with the new licensure requires we provide every resident with the Assisted Living Bill of Rights, not just those on assisted living services.
While those not receiving assisted services do not require a nursing assessment, MDH has determined that an Individual Abuse Prevention plan is needed for each resident. To help you in developing these plans, we are drafting a sample plan for your use.
