UDALSA Clarifications for Assisted Living

An essential requirement of assisted living is the provision of a Uniform Disclosure of Assisted Living Services and Amenities (UDALSA). The Minnesota Department of Health (MDH) has acknowledged that there can be more than one UDALSA per facility if there are varying services in different sections of the building.
An example is a building with a dementia care unit, a unit that provides assisted living services, and a section of the building where only supportive services are available. A provider could have a separate UDALSA for each area of the building or could provide these specifics on a single UDALSA.
It is also important to note that 144G.40, subdivision 2 states that an assisted living facility must provide the UDALSA to prospective residents before a contract is executed. MDH has confirmed this in their survey process on the Resident Observation and Record Review (P5022). To assure compliance with this requirement, place a copy of the signature page of the UDALSA in the resident record or have a receipt of information signature form that allows for individual dating for each form received. If your UDALSA is a component of your assisted living contract, provide it as part of the inquiry process and include documentation in the resident record that the form was received at that time before the contract was signed.
