U.S. Department of Labor Rescinds 2016 Persuader Rule
Posted on July 24, 2018 by Jodi Boyne
The U.S. Department of Labor has rescinded the 2016 Persuader Rule that required employers to report whenever they seek assistance from consultants or lawyers to dissuade employees from joining unions.
The rule never took effect as a federal judge issued a permanent national injunction saying the Persuader Rule was incompatible with the law and client confidentiality.
With the rule removed, employers will only be required to file reports when consultants have been in direct communication with employees.
