Review Recently Published Assisted Living Licensure Rules

The Minnesota Department of Health has announced the Notice of Adoption for the Rules Governing Assisted Living Facilities was published in the State Register on July 19. You may review the Notice of Adoption on the Minnesota State Register website, State Register Volume 46, Number 3 (Page 33).
MDH Submits Modifications to Assisted Living Licensure Rule, Requests Reconsideration

On April 16, MDH filed a response to the Proposed Assisted Living Licensure Rules to the Office of Administrative hearings and requested that Chief Judge Starr review and approve the rule with the modifications proposed. Modifications were made necessary dues to the disapproval of certain aspects of the rule as originally submitted. Other modifications were suggested by the Administrative Law Judge for clarity.
Assisted Living Licensure Rules Report Update

The Minnesota Department of Health (MDH) has filed a response to modify the Proposed Rules Governing Assisted Living Facilities, requesting that the judge review and approve the rule in its entirety with its suggested modifications.
Office of Administrative Hearings Released Report on Proposed Assisted Living Licensure Rules

The Assisted Living Licensure (ALL) Rules Report was issued late last week from Chief Judge Starr and Judge Ann O’Reilly.
Several parts of the proposed rule were disapproved, and the Minnesota Department of Health (MDH) must now decide whether to correct the defects associated with the proposed rules. The Department has several options. It can adopt the corrective actions described by the ALJ and Chief Judge to cure the defects, or it can submit its proposed rules to the Legislative Coordinating Commission for advice and comment. That can take up to 60 days and seems unlikely to be used in this case.
Public Comment Period on Assisted Living Licensure Concludes

The public comment period on the proposed rules for assisted living closed on Tuesday, Feb. 9 at 4:30 p.m. In addition to comments provided during the public hearing held Jan. 19 and 20, over 275 were submitted to the administrative law judge (ALJ) on the topic of assisted living licensure.

Office of Administrative Hearings Holds Hearings on Proposed Assisted Living Licensure Laws

The Office of Administrative Hearings (OAH) conducted a remote-access public hearing on the proposed assisted living licensure rules on Jan. 19th and 20th. This is a critical step in finalizing the rules that will govern assisted living providers under the assisted living licensure law that takes effect later this year.
