SNF Quality Reporting Program Non-Compliance Letters

The Centers for Medicare and Medicaid Services (CMS) has begun notifying Skilled Nursing Facilities (SNFs) that were determined to be out of compliance with the Quality Reporting Program (QRP) requirements for the Calendar Year 2022.
CMS deems a SNF non-compliant if they have not met the QRP data reporting thresholds. SNFs receiving notices will have their Fiscal Year 2024 Medicare FFS Annual Payment Update (APU) reduced by 2%.
It is important to note that SNFs receiving a letter of non-compliance may submit a request for reconsideration to CMS via email no later than 11:59 p.m., Aug. 18.
How do I know if I am non-compliant?
- SNFs deemed non-compliant will receive a notice from the Medicare Administrative Contractors (MACs).
- Non-compliance letters can also be found in iQIES in the “My Reports” folder.
If you do not receive a notice from the MAC or have a letter in iQIES, your organization is considered compliant.
Reconsideration
SNFs can file for reconsideration if it is believed that the non-compliance finding is in error or there is evidence of the impact of extraordinary circumstances that prevented timely submission. Reconsideration instructions are included in the non-compliance notice and on the SNF QRP webpage. Questions not answered in the instructions can be submitted to SNF QRP Reconsiderations.
