New AL License Requirement Added for Renewals After August 1, 2022

An announcement from MDH of a new assisted living license requirement has caused some confusion among providers who have just completed their first AL license renewal. The new provision applies to AL licenses renewed beginning August 1, 2022 and requires evidence showing that at least one resident was served during the previous licensing period to the renewal process.
Confusion arose with the announcement coming so soon after the initial renewal of AL licenses. But for those ALs whose licenses needed to be renewed prior to August 1, 2022, no action is currently required.
The new requirement in Statute 144G.17, states:
A license that is not a provisional license may be renewed for a period of up to one year if the licensee: …(5) provides information sufficient to show the licensee provided assisted living services to at least one resident during the immediately preceding license year and at the assisted living facility listed on the license.
To demonstrate service to a resident, MDH is incorporating into the license renewal process a requirement to submit:
- A copy of a service agreement with a client within the past year; and
- An invoice to a client indicating assisted living services were provided within the past year at the facility listed on the license.
If services were not provided at the facility listed on the license in the immediately preceding license year, the license is not eligible for renewal and MDH must close the license. If the license is closed, the provider must apply for and be granted a new provisional assisted living facility license prior to providing services at that facility.
Again, the new information will be required for AL licenses renewed beginning August 1, 2022, so those who initiated license renewals prior to that date do not need to submit these items for that licensing period.
