Aug. 30 Marks Expiration of Many MDH COVID Waivers

When Minnesota's Peacetime Emergency ended on July 1, it started a sixty-day countdown to the expiration of most Minnesota Department of Health (MDH) COVID-19 waivers or modifications of state laws or regulations.
As summarized in this tracking tool, a number of these waivers affected aging services providers, including nursing homes, home care and assisted living facilities. All organizations relying on these waivers must now have transitioned back to standard practice in these areas.
The CMS Section 1135 blanket waivers of federal regulatory requirements for nursing facilities and other federally-certified providers remain in effect, except for those CMS has specifically terminated, including the waiver relating to nurse aide training and certification. MDH clarified on July 8 that they will waive Minnesota's state-level requirements for nursing assistant training and certification (Minn. Statute, section 144A.61, subdivision 6a) for as long as the CMS blanket waiver remains in effect.
