Assisted Living Director Rules to be Posted for Public Comment December 1

On October 25th, staff of the Board of Executives of Long-Term Services and Supports (BELTSS) submitted the draft Licensed Assisted Living Director rules to the Office of Administrative Hearings (OAH). The rules will be posted for a 30-day public comment period to begin December 1, 2020 (LeadingAge Minnesota will provide a link as soon as it is available). A Statement of Need and Reasonableness (SONAR) has also been prepared and can be viewed on the BELTSS website along with the updated rule draft.
LeadingAge Minnesota members are encouraged to review the draft rule and SONAR. Comments may be submitted to the Office of Administrative Hearings once posted on December 1. In the meantime, members are invited to informally submit a comment to BELTSS. Please also contact Bobbie Guidry at bguidry@leadingagemn.org with any concerns you may have. LeadingAge Minnesota has been actively engaged in the rules development process and will be submitting comments in December.
Funding and authorization to collect fees to stand up the licensure process continue to plague implementation of the new licensure program. At their board meeting last week, BELTSS moved to put forward a bill for funding to establish the process. Since it is unlikely the bill will be passed before the 2021 session begins, the target date to begin accepting applications for licensure for those meeting the “grand-parenting” provisions has been moved from January 2021 to April 2021.
